WARRANTIES FOR PURCHASER: If property is purchased in person, AMDFA guarantees the written description of purchased property for (3) days including purchase date on the front of this form. Returns are only valid on incorrect statements as deemed by AMDFA. If property is purchased online, AMDFA guarantees the written description or photographs of purchased item(s) within (5) days of verified receipt. Verified receipt is defined as delivered date by shipper. Any request of returns for refund must be received within their allotted time frames pursuant to how the property was purchased. AMDFA reserves the right to cancel a sale at any time for any reason.
RETURNING OF PROPERTY: In all scenarios of refund, the property must be returned in the exact same condition as sold to the Purchaser or the Purchaser will forfeit all rights to a refund. Refunds will never occur before AMDFA is in full custody of purchased item(s). AMDFA bears no responsibility to return damaged property to Purchaser. AMDFA has the right to consult any parties they choose regarding refund of property. All returns for refund, either partial or full, are ultimately at the sole discretion of AMDFA.
SHIPPING: AMDFA agrees to ship all items with insurance covering final purchase price. As soon as property is in hands of the shipper, the Purchaser assumes all responsibility for loss, damage, and pursuit of insurance claims.
PAYMENT: Purchasers are to pay for their purchases immediately or upon receipt of an invoice, unless other arrangements have been authorized in writing by AMDFA. Payment may be made by all major credit cards, PayPal, Venmo, cash, or good check payable to Mike Martin. AMDFA reserves the right to hold property until checks clear. A $50.00 fee will be added for returned checks. If a check fails to clear after the second deposit, the Purchaser will be held responsible for any and all fees incurred until we have collected good funds.
EXPORTS: Granting of licensing for import or export of goods from local authorities is the sole responsibility of the buyer. Denial or delay of licensing will not constitute delay or cancellation in payment for the total purchase price of these lots. No refund will be granted for failure to obtain licensing.
AMENDMENT & MODIFICATION: This Agreement may be modified, amended, and supplemented only by the mutual written agreement of the respective parties hereto.
CHOICE OF LAW / VENUE / JURISDICTION: This Agreement shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to the conflict of laws provisions thereof. Any dispute arising out of or relating to this Agreement shall be brought exclusively in the State of New York Superior Court in Onondaga County, New York, and the Parties expressly agree to submit to exclusive jurisdiction of this court.
